1. Definitions

1.1 “FundingAgent,” “we,” “us,” or “our” refers to TTAGZ LTD, the operator and owner of the Site.
1.2 “Site” means https://www.fundingagent.co.uk (and any subdomains) and all content, features, and functionality offered via that website.
1.3 “User” or “you” means any person who accesses or uses the Site.
1.4 “Content” means all text, graphics, images, data, code, audio, video, or other materials on or available through the Site.
1.5 “User Submission” means any information or data you upload, post, submit, or otherwise transmit to us via the Site’s web form (e.g., your name, email, company name, financing needs, etc.).

2. Acceptance of Terms

2.1 By accessing or using the Site, you confirm that you have read, understood, and agree to these Terms.
2.2 If you do not agree to these Terms, you must not access or use the Site in any manner.
2.3 We reserve the right to modify these Terms at any time. Any changes will be effective upon posting the revised Terms on the Site. It is your responsibility to review the Terms periodically. Continued use of the Site after modifications constitutes acceptance of the updated Terms.

3. Eligibility

3.1 You must be at least 16 years of age to use the Site. By using the Site, you represent and warrant that you are at least 16.
3.2 We do not knowingly collect personal data from children under 16. If we become aware that a User under 16 has provided personal data without parental consent, we will delete that data immediately.

4. Use of the Site

4.1 Lawful Purposes Only. You agree to use the Site solely for lawful purposes and in accordance with these Terms.
4.2 Prohibited Conduct. You must not, and must not assist or encourage any third party to:

  • Use the Site in any way that violates applicable laws (including data‐protection, privacy, intellectual property, or export laws).
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Site.
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or secure/password‐protected areas.
  • Interfere with or disrupt the Site, servers, or networks connected to the Site.
  • Transmit any viruses, malware, or other harmful code.
  • Harvest or collect personal data about other Users.
  • Impersonate any person or entity, or falsely claim an affiliation with any person or entity.

4.3 Account Registration. There is no user‐registration system or login required to browse the Site. If you voluntarily provide information via our web form, you remain responsible for the accuracy of the data you submit.
4.4 Termination. We may suspend or terminate your access to the Site at any time, with or without cause or notice, including if we believe you have violated these Terms.

5. Intellectual Property

5.1 Ownership. All Content on the Site (including but not limited to text, graphics, logos, icons, images, audio clips, and software) is owned by or licensed to FundingAgent and is protected by UK and international copyright, trademark, and other intellectual property laws.
5.2 Limited License. Subject to your compliance with these Terms, we grant you a limited, non‐exclusive, non‐transferable, revocable license to access and view the Site solely for your personal, non‐commercial use.
5.3 Restrictions. You may not:

  • Reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any Content from the Site for commercial purposes without our prior written consent.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices on any Content.
  • Frame or mirror any portion of the Site without our prior written permission.

5.4 Trademarks. “FundingAgent” and the FundingAgent logo are trademarks of TTAGZ LTD. All other trademarks on the Site are the property of their respective owners. You may not use any trademark displayed on the Site without the owner’s written consent, except to identify the products or services of the owner.

6. User Submissions

6.1 Form Data. If you choose to fill out our website form, you may submit personal and company information (e.g., name, email, company name, homeowner status, funding details, turnover). By submitting information, you represent and warrant that:

  • The information is accurate and complete.
  • You have the legal right to provide that information.
  • You consent to our processing and (if you opt in) sharing that information with our partner Swoop Finance.

6.2 Grant of License. By submitting User Submissions, you grant us a worldwide, non‐exclusive, royalty‐free, transferable, sublicenseable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with operating the Site and providing our services.
6.3 No Obligation to Use. We are under no obligation to use or respond to any User Submission.
6.4 Monitoring. We reserve the right (but have no obligation) to monitor, edit, or remove any content you submit that we deem, in our sole discretion, to violate these Terms or applicable laws.

7. Privacy and Data Protection

7.1 Your privacy is governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review the Privacy Policy for details on how we collect, use, and share your personal data.
7.2 By using the Site and submitting personal data, you consent to the practices described in the Privacy Policy.

8. Third-Party Links and Services

8.1 Third-Party Links. The Site may contain links to third‐party websites, products, or services that are not owned or controlled by FundingAgent. We do not endorse or assume responsibility for any such third‐party content. If you access a linked third‐party site, you do so at your own risk.
8.2 Partner: Swoop Finance. If you opt in via our web form, we share your submitted data with Swoop Finance. Your relationship with Swoop Finance is subject to their own terms and privacy policies.
8.3 No Endorsement. Inclusion of any third‐party link does not imply our endorsement of that party’s site, products, or services.

9. Disclaimers

9.1 AS IS, NO WARRANTIES. The Site and all Content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, FundingAgent, its officers, directors, employees, agents, affiliates, licensors, and suppliers disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, title, non‐infringement, and accuracy of information.

9.2 No Advice. The Site is for informational purposes only and does not constitute professional advice (financial, legal, tax, or otherwise). We do not give financial advice, and as such, we are not authorised or regulated by the Financial Conduct Authority (FCA). Any information on the Site should not be relied upon as a substitute for seeking independent financial or legal advice.

9.3 No Guarantee of Results. We do not guarantee the accuracy, completeness, reliability, or suitability of any information on the Site, including any financing or funding opportunities. Any reliance you place on such information is strictly at your own risk.

9.4 No FCA Regulation. FundingAgent is not and does not need to be regulated by the FCA because we do not provide regulated financial advisory services or arrange regulated products. All services provided through our Site are introductory only, connecting you (with your consent) to third‐party providers (e.g., Swoop Finance) who may offer financial products. It remains your responsibility to verify the credentials and regulatory status of any third party before proceeding with any transaction.

10. Limitation of Liability

10.1 NO INDIRECT DAMAGES. To the maximum extent permitted by applicable law, in no event shall FundingAgent, TTAGZ LTD, or their affiliates, officers, directors, employees, agents, or licensors be liable for any:

  • Indirect, incidental, special, consequential, or exemplary damages (including but not limited to loss of profits, revenue, data, goodwill, or business interruption),
  • Even if advised of the possibility of such damages, arising out of or in connection with your use of, inability to use, or performance of the Site or any linked third‐party services.

10.2 CAP ON LIABILITY. To the maximum extent permitted by law, our total cumulative liability to you for any claims arising from or related to these Terms or your use of the Site, whether in contract, tort (including negligence), or otherwise, shall not exceed £100.

10.3 EXCLUSIONS. Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages. If these limitations are not allowed in your jurisdiction, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless FundingAgent, TTAGZ LTD, and their affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

  • Your violation of these Terms;
  • Your User Submissions;
  • Your use of the Site or reliance on any Content;
  • Your violation of any applicable law or the rights of a third party.

12. Governing Law and Jurisdiction

12.1 Governing Law. These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.
12.2 Jurisdiction. You agree that any dispute arising from or related to these Terms or the Site shall be brought exclusively before the courts of England and Wales, and you hereby submit to the personal jurisdiction of those courts.

13. Changes to the Site

13.1 We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Site (or any part thereof) with or without notice.
13.2 We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Site.

14. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable under applicable law, that provision will be deemed to be deleted or limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Waiver

No waiver of any term or condition of these Terms by FundingAgent shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

16. Entire Agreement

These Terms, together with the Privacy Policy and any documents expressly incorporated by reference, constitute the entire agreement between you and FundingAgent regarding your use of the Site and supersede all prior or contemporaneous agreements, representations, and understandings.
